Last updated: October 2026
1. Scope
These General Terms and Conditions of Sale (“GTC”) apply to purchases of products and services offered by Schaefer & Companions through www.schaefer-and-companions.art and, where expressly agreed, through direct orders placed with Schaefer & Companions.
By placing an order, the customer confirms that they have read and accepted these GTC before completing the purchase.
These GTC apply without prejudice to mandatory consumer rights that cannot legally be excluded or restricted.
For customers residing in the European Union, mandatory consumer-protection provisions applicable in their country of residence remain unaffected.
2. Seller Information
The seller is:
Schaefer & Companions
Switzerland
Email: info@schaefer-and-companions.art
Website: www.schaefer-and-companions.art
3. Products
Schaefer & Companions creates and sells watches, artisanal watchmaking products, accessories, limited editions, unique pieces and customized creations.
We make reasonable efforts to ensure that all descriptions, technical information, dimensions, materials, photographs, renderings and prices displayed on our website are accurate.
However, handcrafted products may present slight variations in colour, texture, finish, pattern or appearance.
These variations are particularly possible for products involving:
- hand painting;
- engraving;
- enamel;
- straw marquetry;
- lacquer;
- natural materials;
- handcrafted dials;
- individually finished components.
Such variations are part of the artisanal character of the product and do not in themselves constitute a defect.
Photographs and 3D renderings are intended to represent the product as accurately as reasonably possible. Minor visual differences may occur between a photograph, rendering, prototype and the final production piece.
4. Prices
Unless otherwise indicated, prices displayed on the website are stated in Swiss francs (CHF).
Switzerland :
Prices displayed on the product page are exclusive of Swiss VAT unless expressly stated otherwise.
For deliveries within Switzerland, Swiss VAT at the applicable rate is calculated and added at checkout.
The current Swiss standard VAT rate is 8.1%.
Shipping costs are included unless otherwise expressly stated before the customer places the order.
European Union :
For products exported directly from Switzerland to an address in the European Union, Swiss VAT is not charged, provided the requirements for a tax-exempt export are fulfilled.
Swiss authorities require direct export and appropriate evidence of export for the Swiss VAT exemption. Customs and Border Security
Unless the checkout expressly states otherwise, the displayed purchase price does not include:
EU import VAT, customs duties where applicable, customs-clearance charges, brokerage charges or other charges imposed by the destination country or carrier.
These amounts may be requested from the recipient by the carrier, customs authorities or another competent authority before or after delivery.
The applicable amount depends on the destination country, the nature and value of the goods and the rules in force at the time of importation.
Schaefer & Companions does not control these charges and cannot guarantee their amount in advance.
Other international destinations :
For deliveries outside Switzerland and outside the European Union, Swiss VAT is not charged on qualifying exports.
Unless expressly stated otherwise at checkout, local VAT, sales tax, import duties, customs fees, brokerage fees and other destination-country charges are not included in the purchase price and remain payable by the recipient.
General tax rule :
Unless expressly stated otherwise at checkout or in an individual written offer, international shipments are not shipped DDP (Delivered Duty Paid).
Customers are responsible for verifying any taxes, duties or import restrictions applicable in their country before placing an order.
Our website therefore uses the following pricing principle:
Switzerland: Taxes included. Shipping included.
Outside Switzerland: Shipping included. Taxes not included.
For EU customers, additional import charges that cannot reasonably be calculated in advance may therefore become payable upon importation. EU consumer rules require traders to inform customers in advance where such additional costs may arise. European Union
5. Currency Conversion
Where the website displays an estimated price in a currency other than CHF, the converted amount may be provided for information purposes only.
The final amount charged may vary depending on the exchange rate applied by the payment provider, credit-card issuer or bank.
Any foreign-exchange or banking fees charged by the customer's financial institution remain the customer's responsibility.
6. Orders
Placing an order constitutes an offer by the customer to purchase the selected product under these GTC.
An automatic email confirming receipt of the order does not necessarily constitute final acceptance of the order.
Schaefer & Companions may verify:
product availability, payment, pricing, delivery feasibility and order information before accepting the order.
The contract is concluded when Schaefer & Companions confirms acceptance of the order or confirms that the order has entered preparation or production, unless mandatory applicable law provides otherwise.
We reserve the right to refuse or cancel an order where there is a legitimate reason, including:
payment failure, suspected fraud, product unavailability, an obvious pricing or technical error, inability to deliver to the requested destination or a legal restriction preventing fulfilment.
If Schaefer & Companions cancels an order for which payment has already been received, the corresponding amount will be refunded.
7. Availability and Limited Editions
Many Schaefer & Companions watches are produced in limited quantities or as unique pieces.
Availability is therefore not guaranteed until an order has been accepted.
When a numbered or unique piece has already been sold, we may offer another available piece where appropriate, but only with the customer's agreement.
If no suitable replacement is available, any amount paid for the unavailable product will be refunded.
8. Customized, Personalized and Bespoke Products
Certain products may be customized or created according to customer instructions.
This may include:
personalized engraving, bespoke artwork, individually commissioned dials, customized motifs, names, initials, dates, symbols, colours or other customer-specific specifications.
Before production begins, the customer is responsible for checking and approving any personalization information supplied to Schaefer & Companions.
Once personalized production has started, modifications may no longer be possible or may result in additional charges.
For EU customers, the statutory 14-day right of withdrawal does not generally apply to goods made to the consumer's specifications or clearly personalized. EU guidance specifically identifies made-to-order or clearly personalized products as an exception to the withdrawal right. European Union
This exception does not remove the customer's rights if the product is defective or does not conform to the contract.
9. Payment
Available payment methods are displayed during checkout.
Payment must be made according to the conditions displayed before the customer confirms the order.
Where a product may be reserved by paying a deposit, the amount and conditions of the deposit will be clearly communicated before payment.
Unless expressly stated otherwise, payment of a deposit does not remove the obligation to pay the remaining balance.
The remaining balance must be paid according to the agreed schedule and before final delivery unless otherwise agreed in writing.
10. Delivery
Shipping is included unless expressly stated otherwise during checkout or in an individual offer.
Delivery times displayed on the website or communicated by Schaefer & Companions are estimates unless a specific delivery date has been expressly guaranteed.
Handcrafted, limited-edition, personalized and made-to-order products may require additional production time.
For EU consumer sales, unless another delivery period has been agreed, EU rules generally require delivery within 30 days. SME Portal
Where a longer production period is required for a particular watch or bespoke creation, that timeframe will be communicated to the customer.
Schaefer & Companions is not responsible for reasonable delays caused by customs clearance, transportation interruptions, force majeure or other circumstances beyond our reasonable control, subject to mandatory consumer rights.
11. Shipping Address
The customer is responsible for providing a complete and accurate shipping address.
The customer must verify the delivery information before confirming the order.
Additional transportation or administrative costs resulting from an incorrect or incomplete address supplied by the customer may be charged to the customer where legally permitted.
12. Risk During Shipping
Products are packaged with reasonable care and shipped using appropriate delivery services.
For EU consumers, where Schaefer & Companions arranges the carrier, the risk of loss or damage generally remains with the seller until the consumer or a designated third party physically receives the goods.
EU guidance confirms that, where the seller arranged delivery, responsibility remains with the seller until delivery to the consumer. European Union
Where the customer independently appoints a carrier not offered by Schaefer & Companions, different rules may apply.
13. Inspection Upon Delivery
Customers are encouraged to inspect their package and product upon receipt.
Visible shipping damage should be reported as soon as reasonably possible to:
info@schaefer-and-companions.art
Where possible, the customer should provide photographs of:
the outer packaging, shipping label, internal packaging and affected product.
Visible transport damage should also be reported to the carrier where appropriate.
Failure to report a problem immediately does not remove mandatory legal consumer rights.
14. Right of Withdrawal : Customers in Switzerland
Swiss law does not generally provide a statutory cooling-off period for ordinary online purchases.
Schaefer & Companions may nevertheless voluntarily accept a cancellation before an order enters production or is dispatched.
A customer wishing to cancel an order should contact:
info@schaefer-and-companions.art
as quickly as possible.
Cancellation cannot be guaranteed once a customized or personalized product has entered production.
Mandatory statutory rights remain unaffected.
Swiss official guidance confirms that Swiss e-commerce law does not generally provide a statutory withdrawal period. SME Portal
15. Right of Withdrawal : European Union Consumers
Consumers residing in the European Union who purchase online generally have a legal right to withdraw from the contract within 14 days without giving a reason. European Union
For goods, the withdrawal period generally expires 14 days after the consumer, or a third party designated by the consumer, receives the goods.
To exercise the right of withdrawal, the customer must notify Schaefer & Companions clearly before the expiry of the withdrawal period.
Notification may be sent by email to:
info@schaefer-and-companions.art
The customer may use the model withdrawal form provided at the end of these GTC, but use of the form is not mandatory.
16. EU Withdrawal Exceptions
The right of withdrawal may not apply in cases provided by applicable law.
In particular, it does not normally apply to goods:
made to the consumer's specifications or clearly personalized.
This may include a watch or component carrying a customer-requested engraving, individually commissioned artwork or another genuinely personalized specification. European Union
A product is not automatically excluded from the withdrawal right merely because it is produced after the order is placed. The statutory exception applies where the item is genuinely made to the customer's specifications or clearly personalized.
This distinction is important for standard watches produced or assembled after ordering.
17. Returning an EU Order Following Withdrawal
After notifying Schaefer & Companions of withdrawal, the consumer must return the goods without undue delay and within the legally applicable return period.
Unless otherwise agreed, the consumer bears the direct cost of returning a non-defective product following a simple change of mind, provided the customer was informed of this obligation before purchase.
EU guidance confirms that sellers must inform consumers in advance when consumers are expected to bear return shipping costs. European Union
Returned products should be:
complete, appropriately protected and returned with the accessories, documents and packaging supplied with the product where reasonably possible.
The consumer may inspect the product as they would reasonably be able to do in a physical shop.
The consumer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where applicable law permits this.
18. Refund Following EU Withdrawal
Where a valid EU withdrawal right is exercised, Schaefer & Companions will reimburse payments that must legally be reimbursed, including the cost of standard delivery where required by applicable EU law.
Any additional cost resulting from the customer's choice of a premium delivery method instead of the least expensive standard delivery method offered does not have to be reimbursed where applicable law permits.
Refunds will normally be made using the same payment method used for the original transaction unless another method is expressly agreed.
Where legally permitted, Schaefer & Companions may withhold reimbursement until the returned goods are received or until the customer provides evidence that the goods have been returned.
19. Model EU Withdrawal Form
EU consumers may use the following form if they wish to withdraw from an eligible contract:
To: Schaefer & Companions
Email: info@schaefer-and-companions.art
I hereby give notice that I withdraw from my contract of sale for the following goods:
Product:
Order number:
Ordered on:
Received on:
Name of consumer:
Address of consumer:
Email:
Date:
Signature, only if this form is submitted on paper:
EU rules require traders to provide information concerning withdrawal and provide a model withdrawal form for applicable distance contracts. European Commission
20. Defective or Non-Conforming Products
Withdrawal for a change of mind and claims concerning defective goods are separate rights.
A product that is defective, damaged or does not correspond to the agreed specifications should be reported to:
info@schaefer-and-companions.art
with the order number and, where useful, photographs or other information describing the problem.
Mandatory statutory remedies remain unaffected by the commercial warranty offered by Schaefer & Companions.
21. Commercial Warranty
Schaefer & Companions provides a 2-year international commercial warranty beginning on the date of delivery or purchase, according to the warranty documentation supplied with the product.
The commercial warranty covers manufacturing defects in materials and workmanship under normal use.
It does not generally cover:
normal wear and tear; scratches or cosmetic wear caused by use; deterioration of straps resulting from normal use; accidental damage; shocks or impacts; misuse; improper handling; unauthorized repair or modification; damage caused by chemicals; failure to follow care instructions; or damage caused by use beyond the watch's stated specifications.
The commercial warranty is additional to mandatory statutory consumer rights and does not replace or restrict them.
22. EU Legal Guarantee
EU consumers benefit from a minimum 2-year legal guarantee of conformity for new consumer goods.
If goods are defective or do not conform to the contract, the seller may be required to repair or replace them without charge. Where repair or replacement is unavailable or legally insufficient, other remedies such as a price reduction or refund may apply. European Union
National legislation in an EU member state may provide protection beyond this minimum period.
The Schaefer & Companions commercial warranty does not reduce these statutory rights.
As of 27 September 2026, EU rules also introduce a harmonised legal-guarantee notice for relevant sellers of consumer goods in the EU. European Union
Because Schaefer & Companions sells from Switzerland into the EU, this particular new information requirement is worth having reviewed specifically for the EU markets you actively target.
23. Swiss Warranty Rights
Swiss statutory warranty rights remain applicable where required by Swiss law.
Swiss official guidance notes a two-year period for warranty claims relating to defective products. SME Portal
Any additional commercial warranty granted by Schaefer & Companions is provided without prejudice to rights that cannot lawfully be excluded.
24. Warranty Service
Before returning a watch for warranty inspection, customers should contact:
info@schaefer-and-companions.art
The customer may be asked to provide:
order information, the watch reference or serial number, a description of the issue and photographs or video where relevant.
If the problem is covered by mandatory legal guarantee rights, the consumer will not be charged costs that applicable law requires the seller to bear.
For EU consumers, the legal guarantee includes necessary costs associated with legally required repair or replacement. European Union
25. Water Resistance
Where a watch is described as water-resistant, the stated water-resistance rating applies to the product under the specified conditions.
Water resistance is not necessarily permanent.
It may deteriorate due to:
ageing of seals, shocks, temperature variation, servicing, opening of the case or other external factors.
Periodic testing is therefore recommended, particularly before significant exposure to water.
Any limitations specified in the product documentation must be respected.
26. Intellectual Property
Unless otherwise stated, the content available on www.schaefer-and-companions.art is owned by Schaefer & Companions or used with permission from the relevant rights holder.
This includes, among other elements:
brand names, logos, photographs, videos, watch designs, renders, drawings, texts, illustrations, graphics and website content.
No content may be copied, reproduced, commercially exploited, modified or distributed without prior authorization except where permitted by law.
27. Personal Data
Schaefer & Companions processes personal data in accordance with applicable data-protection legislation and its Privacy Policy.
Data may be transmitted where necessary to service providers involved in completing an order, including:
payment processors, banks, hosting providers, logistics providers, carriers, customs intermediaries and professional service providers.
Such transmission is limited to what is reasonably necessary for the relevant purpose.
Customers should consult the website's Privacy Policy for further information concerning the processing of personal data and their rights.
28. Liability
Schaefer & Companions is liable in accordance with applicable mandatory law.
To the extent permitted by law, Schaefer & Companions is not liable for indirect or consequential loss that was not reasonably foreseeable at the time the contract was concluded.
Nothing in these GTC excludes or restricts liability where such exclusion or restriction would be prohibited by applicable law.
Mandatory consumer rights remain unaffected.
29. Force Majeure
Schaefer & Companions will not be responsible for failure or delay caused by circumstances outside its reasonable control.
Such circumstances may include:
natural disasters, war, governmental restrictions, strikes, significant transport disruptions, customs interruptions, major supply-chain disruption, telecommunications failure or similar exceptional events.
If such circumstances materially affect an order, Schaefer & Companions will make reasonable efforts to inform the customer and determine an appropriate solution.
Mandatory consumer rights remain unaffected.
30. Changes to These GTC
Schaefer & Companions may update these GTC from time to time.
The version applicable to an order is generally the version made available to the customer when the order was placed.
A subsequent change to these GTC does not retroactively modify an existing contract unless:
required by law or expressly agreed between the parties.
31. Severability
If a provision of these GTC is held to be invalid or unenforceable, the remaining provisions remain effective to the extent permitted by applicable law.
32. Governing Law
These GTC and contracts concluded with Schaefer & Companions are governed by Swiss law.
However, this choice of law does not deprive a consumer of mandatory protections granted by the law that would otherwise apply to the consumer.
This is particularly relevant where Schaefer & Companions directs its commercial activities toward consumers in an EU member state. EU rules normally continue to protect EU consumers purchasing from a non-EU trader specifically targeting them. European Union
33. Jurisdiction
Disputes are subject to the competent courts determined under applicable law.
Nothing in these GTC requires a consumer to waive a mandatory right to bring proceedings before a competent court in their place of residence.
For Swiss consumer contracts, official Swiss guidance states that consumers may generally bring proceedings either at their own address or at the seller's location and cannot waive that right in advance. SME Portal
Mandatory jurisdiction rules applicable to EU consumers also remain unaffected.
